Tomasz Mielniczuk brings a global perspective and deep antitrust expertise to his practice, with experience advising clients on high-stakes litigation, complex merger reviews, and regulatory investigations on both sides of the Atlantic.

Tomasz’s recent litigation work includes representing Tyson Foods in in multiple major treble-damage class actions alleging industry-wide collusion to raise chicken prices. In the merger review space, he recently secured antitrust clearance for RB Global Inc.’s acquisition of J.M. Wood Auction Co., a recent transaction in the heavy equipment auction industry.
Tomasz earned his J.D. from Georgetown University Law Center. During law school, he served as president of the Georgetown Antitrust Law Association, interned at the Federal Trade Commission, and conducted research for Professor Steven C. Salop.
Before attending law school in the United States, he practiced antitrust law in Europe, advising clients on merger control and competition compliance at international firms in Brussels and Warsaw.
Experience
- Representing Cornell University in an antitrust class action challenging the Veterinary Internship and Residency Matching Program, alleging a conspiracy among veterinary schools and hospital to suppress wages for veterinary interns and residents.
- Defending Tyson Foods, Inc. in a consolidated treble-damages class action alleging an industry-wide conspiracy to manipulate the price of broiler chickens in the Northern District of Illinois.
- Representing Nurture, LLC (a subsidiary of Danone) in a commercial dispute seeking over $10 million in damages for Perrigo-subsidiary PBM Nutritionals’ alleged breaches of its agreement to co-manufacture and supply infant formula.
- Obtained clearance for RB Global Inc.’s acquisition of J.M. Wood Auction Co., a recent deal in the heavy equipment auctions industry.
- Represented Choice Hotels International, Inc. in the proposed acquisition of Wyndham Hotels & Resorts.
- Represented McKesson Corporation in multiple proposed acquisitions in the healthcare sector.
- Represented Tyson Foods, Inc. in its successful acquisition of Williams Sausage Company.
- Represented Accelera, a zero-emissions business unit of Cummins Inc., in its $3 billion joint venture with Daimler Truck North America and PACCAR.
- Successfully defended a Fortune 100 company against a $500 million claim in AAA arbitration.
