Axinn Wins $16 Million Damages Award for Medical Device Client at Jury Trial in Delaware

On behalf of its client DePuy Synthes Products, LLC, a Johnson & Johnson company (“Synthes”), Axinn successfully asserted three patents directed to intervertebral implants used in spinal fusion procedures.
Synthes sued Globus Medical, Inc. (“Globus”) in July 2011, alleging infringement of Synthes’ three intervertebral implant patents by Globus‘ manufacture and sale of three spinal fusion implants -- Independence® ALIF System, Coalition® ACDF System, and InterContinental® Plate-Spacer products. Following a two-week trial in June 2013, a Delaware jury found all three patents valid and infringed, and awarded Synthes over $16 million in damages, which represents a 15% royalty on all infringing sales.
Synthes was represented by Francis Morrison, Matthew Becker and Edward Mathias.
