In antitrust conspiracy cases, plaintiffs may allege misconduct involving multiple co-conspirators while naming only some as defendants, leaving other alleged participants unidentified—creating an “empty chair.” This panel will explore, from both plaintiff and defense perspectives, strategic considerations and best practices for navigating litigation involving absent or unnamed alleged co-conspirators.
