On January 20, Axinn partners Nicholas Gaglio and Peter Herrick moderated virtual panels at the New York State Bar Association Antitrust Section Annual Meeting.
Nicholas Gaglio moderated the panel "I Have Never Seen It Before: The Risks and Opportunities of Merger Reviews and Antitrust Enforcement Addressing Privacy and Areas Outside of Traditional Consumer Welfare." This panel explored how privacy and data security, as well as other nascent areas of review and enforcement scrutiny such as labor and ESG, may be built into a structured, administrable antitrust analysis.
Peter Herrick moderated the panel "Developments in Pharma Antitrust: Evolution or Revolution?" This panel provided a practical update for practitioners and in-house counsel on the latest developments in a shifting landscape, including proposed new legislation to address competition in pharma; Congressional examination of prescription drug pricing practices and “sham” citizen petitions; expanded approaches to pharma mergers, and the FTC’s recent report to Congress and private litigation relating to so-called “rebate walls”.
