ACI 18th Annual Paragraph IV Conference

Axinn partners Chad Landmon and Ted Mathias spoke at the American Conference Institute's 18th Annual Paragraph IV Disputes Conference held April 19-20 in New York. 

On April 19, Chad spoke on the "Skinny Labeling and the Infringement of Repurposed Patents: Winning Strategies, New Approaches to Carve Outs, and Induced Infringement of Method Claims" panel. Panelists discussed the impact of GSK v. Teva, Amarin v. Hikma and their progeny on proving induced infringement; the distinction between skinny labels and partial labels; patentability of further medical use inventions; and what every patent owner needs to consider when labeling FDA-approved products. 

On April 20, Ted spoke on the "Revisiting Damages in an At-Risk Launch Scenario: Questions of Remedies and Valuation" panel. Panelists discussed the questions of royalties, lost profits, and exceptional findings; the grounds for mitigation; and practical consequences of the Supreme Court's WesternGeco decision on Hatch-Waxman damages awards.
