Axinn Secures Dismissal of Class Action Conspiracy Claims for Tyson Foods

Axinn obtained a significant victory for client Tyson Foods in a class action treble-damages antitrust case in the District of Minnesota. The consolidated class action complaint, which sought billions of dollars in damages, alleged an industry-wide conspiracy to manipulate the price of pork by reducing output. On August 8, 2019, U.S. District Judge John Tunheim dismissed the action without prejudice, noting that the plaintiffs – three buyer groups including direct purchasers, indirect purchasers and end-consumers – failed to allege parallel conduct on the part of the defendants. The Axinn team was led by partners Rachel Adcox and Tiffany Rider, and included Alexander Alfano, Felix Gilman, Jetta Sandin, Lindsey Strang, Brooke Oppenheimer, and Brad Kellogg.
