Axinn successfully represented The Stanley Works in its declaratory judgment action against Black & Decker, which had asserted trademark challenges against Stanley's use of a yellow and black color scheme on certain products and packaging. After extensive discovery in which Axinn prevailed on a motion for sanctions against Black & Decker, and with Axinn's motion for summary judgment pending, the firm secured the dismissal of Black & Decker's trademark challenges, thereby ensuring that Stanley could continue to employ its long-established color scheme unchanged.
