Connecticut Supreme Court Unanimously Affirms Summary Judgment for Axinn Client
February 10, 2014
Axinn successfully defended a multimillion dollar contract dispute for insurance broker Brown & Brown with a unanimous victory in the Connecticut Supreme Court.
The case related to Brown & Brown’s 2004 purchase of assets from a Connecticut-based insurance broker. Axinn previously won dispositive motions on all issues in the case in the Connecticut Superior Court’s Complex Litigation Docket for Brown & Brown and successfully defended that victory in the Connecticut Appellate Court.
The Connecticut Supreme Court then granted review of whether the Appellate Court correctly determined that Brown & Brown could not hinder performance of a contract through alleged conduct that took place before the contract was signed. The Court’s unanimous decision sided with Brown & Brown on both the procedural and substantive components of that issue, bringing more than five years of litigation to a successful conclusion for Brown & Brown. In the process, the Court provided important guidance on several issues of appellate procedure for Connecticut litigants.
Brown & Brown was represented by an Axinn team that included Mark Alexander, who argued in the Connecticut Supreme Court, and John Tanski, who argued in the Connecticut Appellate Court.
