On November 14, Axinn partner Koren Wong-Ervin spoke on a panel entitled, "The Relationship Between Standards Development, Patents and Antitrust" at IPWatchdog's Fourth Annual Standards, Patents & Competition Program.
Panelists discussed the tension between standardization and both patent and antitrust law. Panelists also explored if antitrust laws are applicable to private, contract disputes between parties where the disagreement arises from a contractual obligation to offer a license; if antitrust is the right tool for an implementer to challenge the rate being offered by an SEP holder; and if antitrust law is a mechanism for implementers to seek the reduction in royalties.
