Axinn Secures Dismissal of Class Action Conspiracy Claims for Tyson Foods

Axinn obtained a significant victory for client Tyson Foods in a class action treble-damages antitrust case in the District of Minnesota. The consolidated class action complaint, which sought billions of dollars in damages, alleged an industry-wide conspiracy to manipulate the price of pork by reducing output. On August 8, 2019, U.S. District Judge John Tunheim dismissed the action without prejudice, noting that the plaintiffs – three buyer groups including direct purchasers, indirect purchasers and end-consumers – failed to allege parallel conduct on the part of the defendants. The Axinn team was led by partners Rachel Adcox and Tiffany Rider, and included Lindsey Strang and Brooke Oppenheimer.
